Labour’s justice system is no longer based on the crime committed, but on who commits it.
Labour has been accused of creating a “two-tier justice system” after new sentencing guidelines suggested that offenders from minority ethnic, religious, and gender identity groups could receive softer sentences than white men.
The Sentencing Council’s controversial guidance, which is due to come into effect in April 2025, states that pre-sentencing reports should be considered for individuals from ethnic and cultural minority backgrounds, transgender individuals, and other protected groups.
Critics show this will lead to a clear disparity in the way criminals are punished—favouring some while disadvantaging white men.
Two-Tier Justice Under Labour
The backlash has been swift. Shadow Justice Secretary Robert Jenrick described the new guidelines as “discrimination written into law”, stating:
“This is proof that we now have a two-tier justice system under Labour.”
Labour’s Justice Secretary, Shabana Mahmood, has now tried to distanced herself from the guidance, saying she is “strongly opposed” and will seek to overturn it. However, Shadow Justice Secretary Robert Jenrick posted a copy of the meeting’s minutes showing Mahmoud’s team had legally signed the guidance off.
Jenrick said: “The Justice Secretary is trying to play dumb. I’ve read the minutes of the meeting it was agreed and her ‘personal representative’ was there. No objections were minuted. This is the Labour Party’s policy under Two-Tier Kier.”
Keir Starmer has also sneered at those raising concerns, while Deputy PM Angela Rayner dismissed critics as “conspiracy theorists.” But the guidelines speak for themselves.
Under the new rules, the following groups must have a pre-sentencing report before a judge can impose a custodial sentence:
- Those from an ethnic, cultural minority, and/or faith minority background
- Transgender individuals
- Pregnant offenders or new mothers
- Young adults (18-25 years old)
- Women facing prison for the first time
Meanwhile, no such protections exist for other offenders—particularly white, working-class men, who are noticeably absent from the list.
Soft Sentences Based on Identity?

A legal expert told the Conservative and Reformer Post:
“Justice should be blind, but these guidelines tilt the scales. Some groups will be treated more leniently than others, and that is fundamentally unfair. This is clearly punishing white men. It’s unacceptable.”
Conservative MPs have called for an immediate reversal of the guidelines, warning that they will create a dangerous precedent where identity politics trumps equal treatment under the law.
Public Fury Grows
Anger is mounting among the British public, with social media flooded with accusations that Labour is entrenching “woke ideology” into the justice system.
One voter told The Post:
“If you’re a white, working-class man, good luck. You’ll be punished harder than anyone else. How is that fair?”
As pressure mounts on Starmer’s government, one thing is clear: the British people will not tolerate a justice system that picks and chooses who gets punished based on race, gender, or identity.
