Back in 2022, The Conservative Post was the first to call for Britain to leave the European Convention on Human Rights (ECHR).

At that time, MPs like Robert Jenrick and Suella Braverman backed our cause. Now, three years on, more and more politicians are finally waking up to the reality.
Over the last few years, we have seen European judges override decisions made not only by the UK’s Supreme Court, but also by the High Court and the Court of Appeal. That is three of our highest judicial authorities, overruled by an external body. This kind of meddling and interference must stop. The European Court should have no jurisdiction over the UK.
As we have always argued, Britain has some of the finest courts and judges in the world. They are independent, impartial, and accountable to the public through Parliament. We do not need European judges to lecture us on rights and freedoms we ourselves pioneered.
Now, Conservative leader Kemi Badenoch has finally gone further than any of her predecessors. In an interview with The Times, she formally committed to taking the UK out of the ECHR and scrapping the Human Rights Act. She said the convention was “out of control” and insisted that Parliament must remain sovereign.
Badenoch did not shy away from the scale of the challenge, warning: “Our country is getting to breaking point because we are not controlling our borders. People are unhappy. If you cannot deliver the basics for your people, because of a convention which is out of your control, then you should leave. It is not about wanting to leave the ECHR, it is about wanting to make sure we can run the country for the people of this country, not for everybody else who turns up on our shores.”
Her words underline what we have said since 2022: that the ECHR is being used to frustrate Britain’s ability to govern itself and to secure its borders.
To strengthen her case, Badenoch commissioned Lord Wolfson of Tredegar KC, a respected former justice minister, to review the legality and practicality of leaving. His conclusion was clear: leaving the ECHR is “the only way” to ensure true sovereignty over Britain’s borders and welfare policies. Importantly, he also confirmed that leaving would be “compatible” with the Good Friday Agreement.
Critics point out that the ECHR is referenced in the Brexit trade agreement with the European Union. But Badenoch dismissed those fears: “There is no reason why we cannot trade and co-operate and buy and sell because of the ECHR. It would be quite an extraordinary thing for them to do.”
Under the Conservative’s plan, the Human Rights Act will now be repealed, and with it the formal incorporation of the convention into British law. Badenoch’s stance is that rights existed long before Strasbourg courts and that they will continue after: “These rights have existed long before the Human Rights Act, long before the European Convention on Human Rights. I want to make sure that it is the democratic parliament, what people vote for, not an international court that is expanding the interpretations well beyond the original intention.”
This is the crucial point. Britain does not need foreign judges to protect our freedoms. From Magna Carta to the Bill of Rights, from habeas corpus to universal suffrage, the UK has been a global leader in rights and liberties. Leaving the ECHR does not mean abandoning rights, it means ensuring those rights remain rooted in our democratic traditions, interpreted by our courts, accountable to our Parliament, and reflective of the people’s will.
The message is simple: foreign courts should not have the power to dictate to the British people. Britain has always upheld rights. Britain will continue to uphold rights. But those rights must be British, not imposed from abroad.
Leaving the ECHR is not a radical idea. It is the logical next step in taking back control.
