Labour ministers are refusing to force police to record criminals’ biological sex – meaning rapists and other offenders can pick and choose their gender on official records.
A damning report published on Wednesday called for all 43 police forces in England and Wales, plus the British Transport Police, to start logging sex instead of self-declared gender identity. But the Labour Government is dragging its feet, merely saying it will “consider” the findings rather than taking action.
This comes after The Telegraph exposed how police and courts routinely let criminals self-identify, including transgender rapists being recorded as female.
‘BIOLOGY MATTERS’
Critics warn that erasing biological sex from records distorts key statistics, making it harder to track rape trends, run medical trials, and analyse gender pay gaps.
Prof Alice Sullivan, from UCL’s Social Research Institute, led the independent review. She blasted public bodies for their “systemic” failure to collect proper sex data – and warned it was putting lives at risk.
She said: “There seems to be a legal fiction that public bodies cannot collect data on sex. This report should show them that they can.”
Prof Sullivan also hit out at trans activists influencing policy, warning ministers to be wary of “internal activism” in government departments.
POLICE ‘IGNORING MALE CRIMINALS’ PAST RECORDS
The report revealed that many police forces log crimes by male suspects as if they were committed by women – all based on how an offender identifies.
Worryingly, it found that criminals with a Gender Recognition Certificate (GRC) can change their sex on the national police database – without officers even being aware of their previous offending history.
The system’s guidance states that an arrested person who has secretly changed legal sex might be released before police even link them to past crimes through fingerprints.
The report recommends that all offenders – including those with a GRC – be recorded by biological sex, and for terms like “sex assigned at birth” to be scrapped.
NHS UNDER FIRE
The NHS also came under fire for prioritising gender identity over biological sex – leading to dangerous health risks. The review slammed the health service for issuing trans people new NHS numbers that match their chosen gender, meaning critical medical checks could be missed.
Prof Sullivan said this had already resulted in cancer referrals being overlooked, and warned it could have “potentially fatal consequences” for trans patients.
JAIL RULES STILL SHOCKING
Despite Labour’s dithering, trans prisoners with male genitalia or those convicted of serious sex crimes are technically not allowed in female jails – but exceptions still happen.
Take Isla Bryson, a biological man convicted of raping two women while living as a man, who was initially sent to a female prison before being moved amid public outrage.
‘DESTROYING SEX DATA HARMS WOMEN’
Maya Forstater, from the women’s rights group Sex Matters, called the erasure of sex data a “damaging dereliction of duty” that has “caused real harm.”
She told the Telegraph: “The destruction of data about sex has undermined research, policy-making, and even the safety of individuals.”
“This isn’t about kindness – it’s reckless, and driven by bureaucrats more focused on Stonewall awards than protecting the public.”
LABOUR’S GENDER FLIP-FLOP
Labour has already rowed back on plans to make it easier to change gender legally, fearing a backlash from voters and the rise of Reform UK, which has taken a strong stance against “transgender indoctrination.”
Even Keir Starmer has flip-flopped. In 2023, he said “99.9% of women haven’t got a penis,” before later admitting that “biology matters.”
The Sullivan report – commissioned by former Conservative minister Michelle Donelan – was quietly released on the government website on Wednesday.
A Government spokesman said: “Accurate and relevant data is vital for research and public services. We are grateful to Prof Sullivan for her work and will consider the findings.”
But while ministers dither, criminals remain free to rewrite reality – with police and the NHS all too willing to play along.
